Booking Agreement and Booking Conditions

1. Bookings

All bookings are made and accepted subject to the terms set out in these conditions. Third party services offered by us are subject to the conditions of sale of these parties. Your booking will become firm after having received it verbally, by fax, email or in writing on our Booking Form.

2. Payment

The amount due will be stated in our invoice and confirmation of your booking. A down payment of 30% of the rental amount is required within 8 days after receipt of our invoice. Our confirmation will become binding for us after receipt of your down payment plus €50,00 for each additional booking, such as rental car, golf lessons etc. The balance becomes due 30 days prior to your arrival date.

3. Rates

Rates include cleaning service. Electricity and firewood are being charged, when applicable, according to consumption on site. The apartments and villas are fully furnished. Bed linen and hand towels will be supplied but you are required to bring your own beach towel. Confirmed prices may be subject to change in case of important unforeseen circumstances with 4 months prior notice. If such increase exceeds 5 %, you may cancel the confirmation without charge. If your reservation covers different seasons these are charged for in accordance with the respective seasonal prices.

4. Occupancy

The maximum number of clients that can comfortably be accommodated is shown in our price list. Any excess in numbers cannot be admitted and will render the rental contract to become void. Pets are not allowed without our explicit permission.

5. Deposit, Breakage

Breakage must be paid for locally before you return home. We are entitled to request a deposit which may be payable in cash or credit card on arrival.

6. Special Requests

Whilst we endeavor to meet any special request you may have we regret that these cannot be guaranteed. Our confirmation is always for a type of accommodation, not for a particular apartment. We do not accept bookings that are conditional upon special requests being met.

7. Amendment by Client

Should you wish to alter your booking after it has been confirmed, a handling charge of €25,00 may be levied for any change made. If you cannot travel because of serious illness, death or serious illness of a close family relative, you may transfer your booking to another person who satisfies all the conditions of the booking, provided such a transfer is requested in writing at least 7 days before your arrival. We advise to take out a holiday insurance cover.

8. Cancellations

We are allowed to cancel your contract before or during your stay in case of extraordinary circumstances such as war, strike, catastrophes or similar occurrences that render the letting of the accommodation impossible. If you find it necessary to cancel your booking, the following charges will apply: Over 75 days prior to arrival: 30 % of rental amount, 75 - 30 days prior to arrival: 50 % of rental amount, 29 days prior to arrival: 100 % of rental amount. Cancellation charges for other services, such as car hire, may vary.

9. Complaints

If you feel to have justified reason for complaint, you must take this up with Algar Seco Parque immediately who will do their utmost to remedy any problem there may be. If you still remain dissatisfied, any complaint must be made to us within 28 days of your departure. Portuguese law applies throughout. Disputes arising out of or in connection with your holiday that cannot be settled amicably are subject to the jurisdiction of the courts of Portugal and in accordance with our Portuguese General Conditions.

10. Liability

Algar Seco Parque Lda. is not liable for any damages unless they are caused by severe neglect or malice aforethought on our part. We are not liable for any deficiency in public services. As far as we are liable, the liability is restricted to 3 times the rental amount agreed, bodily harm excluded, unless damage to the client has not been caused intentionally or by negligence.

11. Conduct

We request our customers to show consideration for their neighbors and other guests. Please treat accommodation and facilities with respect and care so that other customers will continue to enjoy them. Please leave your accommodation in a clean and tidy condition. We reserve the right to terminate a holiday stay without compensation where the unreasonable conduct of any person in your party or guests might impair the enjoyment, comfort or health of other customers. We reserve the right to charge you (either during or after your stay) for any loss or damage to our property incurred during your stay with us by you or your guests.

12. Arrival and Departure Times

Your accommodation will be ready for you from 3pm on your arrival day. We are happy to welcome you at any earlier time of your arrival and will offer you the use of the facilities of our pool, Bistro, reception and locker. In order to prepare the accommodation for our next customers we request that it is vacated by 10am on the day of your departure. If you are likely to arrive late on the first day of your stay please advise so that arrangements can be made to deposit the keys to your accommodation. Portuguese Law applies to this contract under the tribunal jurisdiction of Portimão.
